Request form for a copy of your tax return from the Revenue Agency

How to notify the tax authorities of your request for a copy of your tax return

For personal, fiscal, administrative, or professional reasons, you may need to obtain a copy of your tax return filed in previous years. The tax return already submitted may no longer be available in your personal records, or it may be requested by private entities such as banks, insurance companies, consultants, employers, or foreign social security institutions. In dealings with public administrations, however, a self-certification is almost always sufficient, as required by Presidential Decree 445/2000. However, when dealing with a private individual, it may be necessary to submit an official or certified copy of the return, and it is precisely in these cases that the tax return copy request form is used .

What is the purpose of requesting a copy of your tax return?

The form is designed to uniquely identify the taxpayer. In the editable file provided by the Agenzia delle Successioni, it is necessary to provide personal details, tax code, place and date of birth, residential address, a telephone number, and an email address (preferably updated) so that the office can contact the applicant in the event of any inquiries or clarifications. The form must be completed accurately, as the requested copy will be searched in the Italian Revenue Agency's online archives, and any inconsistencies could delay its release.

The form includes a specific section if the person requesting a copy is not a natural person, but a legal entity. In this case, it is necessary to specify the title under which the request is being submitted, such as owner or legal representative, and indicate the name of the company or entity, its registered office, and its tax code or VAT number. In this case, too, the accuracy and completeness of the information is essential to allow the office to correctly identify the declaration in question.

How to request a copy of your tax return

Once the applicant has been identified, it is necessary to specify whether you wish to obtain a simple copy or a certified copy of the original. A simple copy is used for internal purposes or private relationships that do not require a particularly formal certification. A certified copy, on the other hand, has full legal value and certifies that the copy issued faithfully reflects the original document on file, making it necessary when the recipient entity requires an "official" document recognized by the public administration.

The applicant must then specify which returns they wish to retrieve. Multiple returns from different years can be included in the form, specifying both the type of form used (e.g., Form 730, Personal Income Tax Form, Single Form, etc.) and the tax year to which the return refers. This information is crucial, as returns are archived by tax period and form type, and the Revenue Agency will only be able to retrieve documents relating to returns actually submitted.

Issuing copies requires the payment of the relevant administrative fees. Certified copies also require the application of a stamp duty at the rate established by law. Payment can be made using the F23 form or, in the case of stamp duty, using a pre-printed stamp. It is always advisable to verify, before submitting, the actual amount due in relation to the number of pages that the office will communicate when processing the request.

Where and how to submit the request for a copy of your tax return

Once completed and signed, the form can be submitted to the Territorial Office of the Revenue Agency. Submission can be made in person , through a proxy, or, where the office permits, via certified email. A third party can also be authorized to collect the copy, provided the appropriate section of the form is completed, indicating the identity document details of the person responsible for collecting it and attaching a copy of the applicant's ID.

The final section of the form is reserved for the office: the operators will identify the applicant or any delegate, note the details of the document presented, and record the delivery. This step ensures the traceability of the procedure and the protection of tax data, which is subject to confidentiality.

The relationship between the request for a copy of the tax return and the inheritances

The relationship between the request for a copy of the tax return and inheritance matters is fiscal and documentary in nature and is crucial for the proper management of the inheritance.

The heirs assume all tax obligations of the deceased. They are required to file tax returns on behalf of the deceased, covering the period from the beginning of the year to the date of death. Requesting copies of previous tax returns can help the heirs reconstruct the deceased's tax status and verify any tax debts or credits (such as VAT refunds, tax credits, etc.) that fall within the estate.

Although inheritance tax is applied to the net value of the estate (real estate, personal property, receivables, etc.), the tax return and related tax documentation can be useful for correctly assessing the deceased's assets and liabilities. For example, to determine the value of company shares, financial income, or to identify any existing debts owed to the state.

To unblock the deceased's bank and postal accounts (current accounts, deposits, etc.), the heirs must submit a series of documents, including the inheritance declaration. Although requesting a copy of the tax return is not always required to open the inheritance procedure, tax documentation generally helps define the estate.
