What happens after 20 years from the donation?

Before the amendments introduced by the Simplification Bill (DDL Semplificazioni), after 20 years from the registration of the donation, the buyers of the donated properties could be considered in connection with any possible reduction actions by the legitimate heirs. However, with the new legislation, this time limit has been removed. Now, legitimate heirs can only request the return of the property if it has been transferred free of charge, and the recipient is insolvent.

Therefore, after 20 years from the donation, the protection remains unchanged, further consolidating the security of real estate transactions involving donated properties.

 

How to prevent a donation from being contested?

The registration of the reduction request must now occur within three years from the opening of the succession, significantly reducing the time frame from the previous ten years.
