Inherited Car: How to Become the Rightful Owner

Inheriting a car is a very common situation after the loss of a family member and, for this very reason, deserves to be approached with care and awareness. The deceased's car is not a "secondary" asset, but is fully part of the estate and, as such, is subject to the rules of succession, tax obligations, and administrative formalities required by law.

From a legal standpoint, the vehicle becomes part of the estate and can be attributed to a single heir or remain in joint ownership among multiple heirs. In the first case, the car is registered in the name of one of the entitled heirs, who becomes its sole owner. In the second case, all heirs are co-owners and must jointly decide how to manage the asset, whether to use it, sell it, or proceed with a subsequent division. The allocation of the car can take place according to what is established by a valid will, if one exists, or, in its absence, following the rules of legitimate succession, which identify the heirs and their respective shares.

It is not uncommon for a particularly valuable or luxury car to be included in the inheritance. Even in this case, the vehicle is treated like any other movable asset, but requires greater attention to certain specific aspects. Luxury cars, in fact, can significantly impact the overall value of the estate and, consequently, the taxes owed. It is important to verify that all documentation is complete, including any accessories, customizations, special features, or current warranties, as these elements can increase the tax value of the asset and become relevant in the event of inspections or disputes. An often overlooked aspect concerns the vehicle's ownership. Even if there is no sale, the law requires updating the data in the Public Automobile Registry. Until the transfer of ownership is registered, the car is formally registered in the deceased's name, with all the associated consequences. This can create insurance problems, as the company may refuse compensation in the event of an accident or theft, as well as generating legal and administrative complications for the heirs.

Once the inheritance has been accepted, the transfer of ownership of the car must be registered with the PRA (Register of Automobiles and Motor Vehicles) within the legal deadlines, generally within sixty days. This requirement allows the transfer of the asset to be effective and avoids penalties or irregularities. In the case of multiple heirs, the car can be registered in the name of just one of them, by prior agreement, or all co-owners can be listed. For high-value vehicles, it is often advisable to also have a professional appraisal carried out to declare a correct value and reduce the risk of tax disputes.

Once the transfer of ownership is completed, insurance coverage must be taken care of. The policy in the deceased's name is not automatically valid for the heir, so it will be necessary to transfer it, if permitted, or take out a new one in the new owner's name. This step is also essential to be able to drive regularly and avoid insurance shortfalls.

Regarding the car tax, it is important to know that the tax remains due even during the inheritance process. Any arrears must be paid and, depending on the situation, payment may occur before or after the transfer of ownership. In any case, regularization of the tax is often required to complete the PRA procedures.

The heir is not obligated to keep the car. Once ownership has been acquired, he or she can decide to sell it, scrap it, or transfer it to another heir, agreeing on the terms and any adjustments. There is also the option of waiving the inheritance, but it is important to remember that the waiver applies to the deceased's entire estate and cannot be limited to just the vehicle. It is therefore a delicate decision that must be carefully considered, possibly with the support of a professional.

Relying on a specialized inheritance agency, such as Agenzia delle Successioni, allows you to manage all these steps correctly and calmly, avoiding errors, delays, and complications. Qualified assistance is particularly useful when the inheritance includes valuable assets, such as luxury cars, or when there are multiple heirs and complex situations to coordinate.
